TERMS AND CONDITIONS OF WORK FOR CUSTOMERS

INTRODUCTION: These Terms and Conditions are intended to formalize and structure the terms of Customers and Amway cooperation.

AMENDMENTS: Amway has the right to amend the Terms and Conditions of work for Customers, in whole or in part, by publishing information about such amendment in the official Amway’s literature or on the official Amway’s website, as well as through other ways and mechanisms permitted by law. All amendments will take effect on the date of publication or such later date as specified in the notice. Amway is entitled to introduce amendments relevant to any kind of discrepancies, clerical, or typographical errors without prior notice.

REQUIREMENTS: Amway reserves the right to refuse registration and to reject any registration form unilaterally. Without prejudice to Amway’s right to refuse to register any person as a Customer, the person applying for the status of the Customer must:

  • be under 18 years old;
  • not serve a sentence or be under control of any correctional institution, and not to be an individual whose activity or right to be registered as a Customer is under a ban;
  • not be a holder of an existing ABO Agreement or not act as a nominated person under the existing ABO Agreement;
  • not be officially married to a person who is a party to an existing ABO Agreement;
  • not be suspended from Amway activities due to violation of provisions of ABO Agreement.


Besides, to confirm the VIP Customer status:

  • be an Amway Registered Customer;
  • consume Amway products for the total amount minimum of 20,000 rubles within 12 months from the date of registration with the Company.
     

ACCEPTANCE; ENTRY INTO FORCE: The registration form is deemed concluded and enters into force on the date of its registration with the Company. The Company shall inform the Customer of date of form registration upon the latter’s request or in any other manner at the Company’s discretion. In this case, the Customer shall place an order for Amway products within thirty (30) calendar days from the date of registration.

The VIP Customer status is assigned to the Amway Registered Customer automatically after placing orders for the amount of 20,000 rubles in total within 12 months from the date of registration with the Company. To maintain the VIP Customer status, the Customer should make purchases to the amount of 20,000 rubles cumulatively each year. On achieving the VIP Customer status, the discount for Amway products is 23%. The Company shall inform the Customer of the date of changing the status of the Customer to the VIP Customer upon the latter’s request or in any other manner at the Company’s discretion.

In the event that the VIP Customer does not confirm the status in accordance with clause 3.7 of the Terms and Conditions of Work for Customers, Customers registered on his/her recommendation interact with the person who has told about the Amway business to this Customer. The VIP Customer shall confirm his/her VIP Customer status in six-month (6) term in order to continue communication with the Customers registered on his/her recommendation. After the specified period, the changes that have occurred are considered final.

TERM OF REGISTRATION FORM: If the registration form has not been terminated by the Customer or Amway, its validity automatically expires 365 calendar days after the date of registration provided that there are no orders for Amway products within the specified period of time. Extension of the registration form validity term after such a deadline is not provided; accordingly, the Customer is entitled to apply to Amway for conclusion of a new registration form.

CHANGE OF THE PERSON WHO HAS TOLD YOU ABOUT AMWAY:  In the event that the Customer intends to change the person who has been indicated when registering as a person from whom Customer learned about Amway, the Customer must do it independently on its personal page on the official Amway website.
In the event that another person has been registered with the Company upon the recommendation of the VIP Customer, the change of the person, from whom the VIP Customer has learned about Amway, for such VIP Customer as well as for other Customers will be performed on the basis of the Company’s internal procedures.
In the event that the VIP Customer who has told other registered Customers about Amway intends independently to change the person who has been indicated upon registration as a person from whom the Customer has learned about Amway, that is, excluding the Customers who have registered on his recommendation, then such VIP Customer should submit to the Company a written application as well as a written confirmation of the current and the new persons who have told the Customer about Amway. 
In the event that other Customers are registered with the Company upon the recommendation of the VIP Customer, then such VIP Customer may terminate the registration form as a VIP Customer and re-register as Customer under another person who has told him/her about Amway. After such Customer confirms the VIP Customer status again or its ABO status, such VIP Customer will be able to recommend other people to register with the Company only following six (6) months from the date of termination of initial registration as a VIP Customer.
In the event that the Customer has previously been an ABO, and then has changed the status to the Customer to change the registered person who has told him/her about Amway, followed by registration as an ABO, the Customer must wait 6/24 months of inactivity from the date of termination of the original registration as an ABO.
RULE OF PRODUCT RETURN: Upon expiration of registration as a Customer or upon a voluntary termination of registration by the Customer, the Customer may apply to Amway for return of Amway products; therewith the products must be in the integral, unused, and their original state. Amway will buy back such products at the price that has been paid by the Customer upon purchase, less overheads of processing the order, as well as less any debts to Amway, according to the procedure specified in the document “Amway’s Guarantees”.

PROMOTION OF AMWAY PRODUCTS: The Customer may not buy Amway products for resale, promotion and/or transfer to third parties.

MISCELLANEOUS

7.1 LOYALTY PROGRAM: VIP Customers participate in loyalty programs and can use active discounts. Bonuses for all programs are transferred to a discount account and can be used in the form of discounts for further purchases of Amway products.

OBTAINING ABO STATUS: VIP Customers should register with the tax authorities and execute the Paid Services Agreement to obtain the ABO status, monetary bonuses from the Company, as well as to participate in incentive programs for ABOs.
PASSPORT DETAILS: VIP Customer should provide passport details to the Company in the event that, at least 3 people have registered with the Company upon recommendation of the Customer.

USE OF AMWAY’s NAME, TRADEMARKS, AND COPYRIGHTS: The Customer may not illegally use or assume trademarks or other intellectual property of Amway.
VIOLATION OF TERMS AND CONDITIONS OF WORK FOR CUSTOMERS: In the event of violation of the Terms and Conditions of work for Customers, Amway has the right to unilaterally refuse to fulfill its obligations upon agreement with the Customer, by sending to such Customer a written notice or an e-mail notification about termination of its registration form, and discontinue thereby, the right of such person to purchase Amway products as a Customer.
